View Full Version : Moving violations
By having my license suspended twice during the past year, I'm starting to think that I can't afford NYS license anymore :). I'm looking for ways to escape the points.
I was thinking to become a permanent IL resident (have friends there), but I just found (http://www.sos.state.il.us/publications/rr/rr_chap06.html#your_driving_record) this:
The Secretary of State’s office keeps records of the traffic violations and accidents you accumulate while you are a resident of Illinois. If you are convicted of a traffic violation while driving in another state, it will be included on your record as though it happened in Illinois. If you are not a resident of Illinois and you are convicted of an immediate action traffic violation in Illinois, a record will be established for you in Illinois and the traffic violation also will be forwarded to your home state. You may purchase a copy of your driving record at any full-time driver services facility for a fee of $6.
So since they treat out of state violation as if they happened in state, there is no point of getting IL license.
With NY license I only get points in NY, and in Quebek, and Ontario, Canada... Weird... Not as bad as with IL.
Here is what I found (http://www.nysdmv.com/dmvfaqs.htm#tickets) on NYS DMV (http://www.nydmv.state.ny.us) site.
New York DMV does not record out-of-state violations committed by NYS drivers in other jurisdictions, except for out-of-state alcohol or drug-related violations (e.g. DUI) and moving violations committed in Quebec and Ontario. Therefore, except for violations in Ontario and Quebec, points are not added to your NYS record for out-of-state violations.
Next state to check out would be Tennesse :).
I won't stop until I find my new home :).
Move to Mexico, I bet then u wouldn't get points to your license for out-of-state violations, except for cases involving cocaine dealership:)

Man, I'm really sorry to hear that. Is the suspention for 2 months, or 6? My first one was 2 month, and now this one is 6 month. Sucks so much.
I don't think that the system is centralized though. I've never gotten any points for out of state tickets. And I found a piece about that on NYDMV site, unless of course the site is outdated.
Also I remember asking my lawyer, and him confirming that I only get points for NY, and Canada(?!). Granted that was a year ago or so.
So I believe that this out of state license thing will still work.
P. S. Good thing my girl friend has a driver's license, and since we live together, I don't feel the lack of my own license as much as I would.

Thanks Honey :)
I know for sure that when you get a ticket out of state the points won't count. Last year I was driving in FLorida (September) and I got a ticket 17 miles over, and the sheriff said that I will not get any points for it in NY. And I didn't. Also, DR2000 and I were driving to Florida ( February) and he got a ticket in Virginia, also for speeding. He didn't receive any points for that.
That's 'cause you have a NY license. I have an IL license, so any moving violations will get recorded in both the state I made the violation, and IL. I wonder if my criminal record ever got to IL...
Yeah, that's what I found on IL site.
Here are some things from Tennesse site:
Because our computer systems are not yet as up-to-date as we would like...
That sounds really encouraging :). I like, I like :).
Here's a piece about violations in other state:
Tennessee is a member of the Non-Resident Violator
Compact. The compact is an agreement between states to
ensure that a person receiving a citation for a traffic violation
appears in court or otherwise complies with the terms of the
court for the citation.
In a nutshell, this compact means that regardless of where
you receive a citation for a traffic violation, you must either
appear in court to answer the citation or meet any other
requirement the court may set out to satisfy the citation. If you
ignore the citation — whether it was issued for a traffic
violation here or in another member state, your driving
privileges will be canceled or suspended.
The same consequences apply to non-residents who
receive a citation in Tennessee and fails to answer the citation.
The suspension remains in effect until the court notifies
Tennessee that the citation has been properly disposed of and
the proper fees are paid to this department.
I guess that pretty much means that you have to pay tickets from other states, but you don't get points.
Also while I was looking for that info I got the following question: If I have a license in TN, does that affect how I fill out my NY taxes, or anything like that?
I hate Illinois can i move to NY :)

That would just complicate a lot of things. The good thing (as I'm seeing so far) is that the DMV is a completely separate branch from everything else. I don't think they share your information, and you definitelly don't need to show your license to anyone but cops, or as an ID at strip clubs and such. So if you change ur license, leave everything else be.
I have a NJ lic and Pay NY State taxes for my house on Long Island
there hasnt been a problem for the past 3 years im in NJ
I had to give my conviction stub to the dmv here and they had to verify no points on my lic (None in 18 years yet knock on wood) so most states check when you swap lic.
Cool. Thanks for the bit of usefull information. I don't really care if they account for current points, since I did earn them. I'm just trying to avoid future ones. I don't mind paying fines at all, but points are killing me.
Hi Gang,
I'm currently a GA resident and recently got a ticket for going 80 in a 65 zone in VA. I found out, through the VA DMV site, that it's a 4 point ticket with an $87 fine.
Does anyone know if NJ, GA, or CA are states that penalize drivers for out of state points? I ask about the multiple states because I'll be living in GA for about another year for school. When I'm finished, I've narrowed it down to NJ and CA as to where I'm going to set up shop.
Any help here would be greatly appreciated. Thanks.
All those states will assess points for out-of-state violations. GA is not in the compact, but will still assess points.

You're better off moving to South Dakota. They don't give you points for speeding, at all:).
The Compact information was most appreciated, even if the end result will cost me in the long run.
Thanks again.
Are you guys losing them just from points?
If so that's nuts... Sounds like the cops don't like you guys. Hmmm, maybe they have 9C1 envy :D
